You must meet the following eligibility requirements, which may be changed at any time by The Price Is Right Productions, Inc. (“Producer”) in its sole discretion, in order to participate in “The Price Is Right” (the “Program”).. You understand that any appearance that you may make on the Program is strictly for the purpose of participating in the Program as a contestant or audience member, that your appearance is not a performance and does not entitle me to wages, salary, or other compensation.

ELIGIBILITY REQUIREMENTS

1. You are at least eighteen (18) years of age.

2. Except as listed immediately below, to the best of your knowledge, neither you, nor any member of your immediate family, are now or have been within the previous six (6) months, employed by:

(a) CBS Broadcasting Inc. (“CBS”), its parent ViacomCBS Inc., subsidiaries, or affiliates, or any television station that broadcasts the Program;

(b) The Price Is Right Productions, Inc., Fremantle Goodson, Inc., FremantleMedia North America, Inc., Television City Studios, Hackman Capital Partners, or any parent, subsidiary, or affiliate thereof;

(d) Any person or company that produces any program shown on any CBS television station (i.e., any television station that is affiliated with the CBS Television Network and/or any ViacomCBS cable networks).

3. Please list below the names of each person that you know who is an officer, employee, agent or representative of any of the companies described in 2. above:*

4. You are not presently a candidate for public office and will not become a candidate for public office prior to the broadcast of your appearance on the Program (if any), or until one (1) year from the date of filling out this application, whichever first occurs.

5. You represent and warrant that:

(a) Within the last ten (10) years, you have not been a contestant on any television version of THE PRICE IS RIGHT.

(b) You have not taped an appearance as a contestant or participant on any other television game show which has been (or may be) aired within one (1) year of you filling out this application.

(c) You have not been a contestant on more than four (4) other television game shows of any type within ten (10) years of your filling out this application.

All eligibility determinations shall be made solely by Producer in its sole discretion and are final and binding in all respects. In addition, Producer reserves the right at any time to render any person who, in Producer’s sole discretion, is sufficiently acquainted with any person or entity connected with the development, production, administration, judging or exhibition of the Program such that his or her participation in the Program could create the appearance of impropriety.

RELEASE AND WAIVER

I hereby acknowledge that:

1. I understand and agree to be bound by the eligibility requirements for THE PRICE IS RIGHT.

2. I have answered and will answer all questions posed to me honestly and accurately.

3. If any of the information that I have provided or will provide is found to be false or incomplete, it may be grounds for dismissal from the participant selection process, and/or my being dismissed as a participant, if previously selected as a participant.

4. Even if I meet the eligibility requirements, the CBS Broadcasting Inc. ("Network"), Producer, ViacomCBS Inc. (“ViaCBS”), and/or any of their respective licensees, assignees, partners, parents, or affiliated or subsidiary companies, have no obligation to conduct any initial and/or follow-up interview with me, and/or select me as a participant.

5. In the event that the show is cancelled, or not broadcast for any reason, the Producer shall have no obligation to award any prizes.

6. All of the Producer's decisions concerning the selection of the participants and the elimination of participants in the Program is final and not subject to challenge or appeal.

7. The Producer shall have no obligation to return or maintain any materials submitted as part of my application whether or not I am selected as a participant.

By submitting this application, I grant to the Network, ViaCBS, Producer and its licensees the right to use my name, likeness, portrait, recorded casting tape and biographical material, in order to advertise, promote or publicize THE PRICE IS RIGHT or its licensees. I release Producer, the Network, ViaCBS and/or any of their respective licensees, assigns, parents, partners, subsidiaries or affiliated entities and each of the employees, agents, officers and directors of the foregoing entities (collectively “Releasees”) from any and all liability arising out of the use of my Likeness and/or the Materials. I agree not to make any claim against Releasees as a result of the recording or use of my Likeness and/or the Materials (including, without limitation, any claim that such use invades any right of privacy and/or publicity and any claims based on defamation or libel or false light). I understand that the Producer makes no representation that such Materials will or will not be used in any way. Any of the rights granted herein may be exercised by the Producer and their respective authorized agents, licensees, contractors, partners, successors and assigns. I understand and agree that the Network and others are third party beneficiaries to this agreement, and I acknowledge and agree that my performance of any obligations under this agreement is intended to benefit the Network.

This agreement shall be deemed to be entered into in Los Angeles County, California, and shall be governed by and interpreted in accordance with the laws of the State of California applicable to agreements executed and performed entirely within the State of California.

Producer, CBS, ViaCBS and I agree that any and all disputes or controversies arising under this agreement or any of its terms, any effort by any party to enforce, interpret, construe, rescind, terminate or annul this agreement, or any provision thereof, and any dispute as to the arbitrability of any claim brought by Producer, CBS, ViaCBS or me, shall be resolved by binding confidential arbitration in accordance with the following procedure: either (i) Producer, CBS and/or ViaCBS on the one hand, and I on the other hand, shall mutually select a neutral arbitrator or (ii) if we cannot agree on such arbitrator, Producer, CBS and/or ViaCBS on the one hand, and I, on the other hand, shall each select one neutral arbitrator and those two arbitrators shall then select a third neutral arbitrator to solely preside over the proceedings. Unless the parties agree otherwise, the neutral arbitrator will be a former or retired judge or justice of any California state or federal court with substantial experience in matters involving the entertainment industry. All arbitration proceedings shall be conducted under either the JAMS streamlined (for claims under $250,000) or the JAMS comprehensive (for claims over $250,000) arbitration rules and procedures, except as modified herein, in effect at the time the request for arbitration is made (the “Arbitration Rules”), at the Los Angeles office of JAMS, or its successor (“JAMS”). Producer, CBS, ViaCBS and I agree that the arbitrator’s ruling in the arbitration shall be final and binding and not subject to appeal or challenge. Producer, CBS, ViaCBS and I further agree that the arbitration proceedings, testimony, discovery and documents filed in the course of such proceedings, including the fact that the arbitration is being conducted, will be treated as confidential and will not be disclosed to any third party to such proceedings, except the arbitrator, the arbitrator’s staff, the parties’ attorneys and their staff, and any experts retained by the parties. Producer, CBS, ViaCBS and I agree that, notwithstanding the foregoing, nothing in this paragraph or in any of the Arbitration Rules, shall prevent Producer, CBS and/or ViaCBS from seeking provisional relief outside of arbitration, including but not limited to equitable and/or injunctive relief, pending the arbitrator’s final decision.

ELECTRONIC SIGNATURES
This application may be executed by original, facsimile or electronic signature. Any signed copy of this application delivered by facsimile or electronic transmission shall for all purposes be treated as if it had been delivered containing my original signature, and shall be binding upon me in the same manner as though an original signed copy had been delivered.

SEVERABILITY
The illegality, invalidity or unenforceability of any provision of this application shall in no way affect the validity or enforceability of any of the remainder of this application, which shall be enforced to the maximum extent permitted by law.

I have read, understand, and agree with the foregoing. I UNDERSTAND THAT I AM GIVING UP CERTAIN LEGAL RIGHTS UNDER THIS APPLICATION, INCLUDING, WITHOUT LIMITATION, MY RIGHT TO FILE A LAWSUIT IN COURT WITH RESPECT TO ANY CLAIM ARISING IN CONNECTION WITH THIS APPLICATION.
